The set of data you provided to buy and download AUTOVIEW will be stored savely and used exclusively by us to give you a good service. We shall not share this information with third parties. 

Licence agreement

concluded between

AUTOVIEW Crash Analyse e.U., FN 480694d, Reklewskigasse 2-10/9, 1230 Wien (“AUTOVIEW“)

and

You  (“Customer”)

as follows:

1. Subject matter of the contract

The subject matter of the contract at hand is a single drawing or the “AUTOVIEW database for vehicle drawings”, a collection of copyright protected CAD drawings, including their structure, organization and file system (referred to in brief as “database”), which is being purchased by the Customer for permanent use in consideration of payment of a one-off fee and which is being delivered on a DVD as a data carrier or which will be downloaded by the Customer at www.autoview.at  The database only consists of drawings and in order to be able to use the views, the Customer requires one of the application programs listed in Enclosure 1. The purchase and delivery/installation of the respective application program is not included in this contract. AUTOVIEW is the owner of the rights of use.

2. Scope of use, granting of rights

2.1. The customer acquires a perpetual, non-exclusive and non-transferable right to use the database exclusively for purposes of accident reconstruction, technical visualization, architectural planning/design and graphic design within the customer’s company. Use is limited to one company location within the EEA and a maximum of 5 workstations (workstation, notebook, tablet, etc.). In the case of installation within a local network (LAN), a maximum of 5 persons may access the data simultaneously. Use at multiple company locations, on more than 5 workstations, by more than 5 persons within the network, as an intranet solution or within cloud-based multi-user systems requires a separate written agreement.

The customer is entitled to reproduce the database solely to the extent necessary for contractual use, in particular for installation, loading and backup purposes. Any further reproduction is prohibited.

2.2. The customer is not permitted to rent, lend, sublicense, transfer or otherwise make the database or parts thereof available to third parties.

2.3. Without prior written consent of AUTOVIEW, the customer is in particular not permitted to:

modify the structure of the database or the data format,
implement the drawings or derived data into software, databases or automated systems,
automatically extract, analyze or process the database or drawings, including extraction of geometry, measurement, structural or other technical data,
use the database or drawings for machine learning, AI training or comparable automated systems,
create or have created 3D models, parametric models, meshes or other digital vehicle models from the drawings or derived data,
use the database or drawings for the development, extension or population of competing databases, model libraries, software products or similar systems,
apply reverse engineering or comparable methods to the database or its structure.

2.4. If the customer permanently ceases use of the database, all copies of the database, including backup copies, must be completely and irreversibly deleted, unless statutory retention obligations apply.

2.5. The customer is obligated not to remove, alter or manipulate copyright notices, markings or control identifiers of AUTOVIEW on the database or on copies thereof under any circumstances.

2.6. The customer acquires a perpetual, non-exclusive right to reproduce and modify individual drawings for purposes of accident reconstruction, technical visualization, architectural planning/design and graphic design to the extent necessary for such purposes.

Public distribution of unmodified or only insignificantly modified individual drawings, transfer of source data, creation of competing data collections or use for generating new vehicle models or databases is prohibited.

All rights to the original drawings, data structures and data collections remain exclusively with AUTOVIEW. The customer does not acquire ownership of the underlying data collections or their structure.

Term of Use

3.1. The customer’s rights to use the database and/or individual drawings under the provisions of this agreement are granted for an unlimited period of time. The right of use is granted upon full payment of the agreed remuneration.

3.2. In the event of a material breach of the license terms, in particular unauthorized transfer, use for creation of competing data collections or use contrary to clause 2.3., AUTOVIEW shall be entitled to revoke the granted rights of use for good cause.

4. Fees

The purchase price of the drawings and the granting of the licence amounts to

€ 655    for a full version of AUTOVIEW-database

€ 510    for an update2026 to a full version AUTOVIEW2024 or earlier

€ 250    for an update2026 to a full version AUTOVIEW2025

€ 9,5        for a single drawing (single view, single format)

plus the statutory value added tax. The total purchase price (including value added tax) shall be due at the time of the full download of the database from the www.autoview.at website and shall be remitted via electronic payment.

5. Set off

The right of set off shall be excluded.

6. Warranty and liability

6.1. The Customer shall be obliged to check the database for functionality immediately following delivery/download within 5 working days. Should the Customer become aware of defects within the framework of this check, it shall be obliged to immediately forward on to AUTOVIEW a written defect complaint precisely stating the defect that has been found. Otherwise, warranty claims, damages claim due to the defect itself and due to an error concerning the freedom of defects of the object shall be forfeited.

6.2. The warranty period shall run until the expiry of 12 months following the day of delivery/download, regardless of the inspection obligation.

6.3. Should the Customer unilaterally alter the data inventory and/or the data format, it shall forfeit all warranty claims.

6.4. AUTOVIEW hereby provides a guarantee that the database and the original drawings are free from third party property rights that would restrict or exclude use in accordance with the contract. The Parties shall, however, immediately inform each other should claims be asserted against them due to a breach of property rights.

6.5. AUTOVIEW shall only incur liability within the framework provided by law, namely for intent and gross negligence. The liability shall be limited to the amount of the concrete contractual fee. Specific properties of our drawings cannot be guarateed. 

7. General provisions

7.1. Austrian law shall apply exclusively. The applicability of the United Nations Convention on Contracts for the International Sale of Goods and other reference norms shall be expressly excluded.

7.2. The place of performance shall be the place of business of AUTOVIEW.

7.3. The place of jurisdiction shall be the competent court in Wien, Austria.

7.4. Enclosure 1 forms an integral part of this contract.

7.5. Any oral or written agreements that were undertaken prior to the conclusion of the contract shall cease to apply on signing, should these concern the subject matter of the contract; the general terms and conditions of business of AUTOVIEW shall apply exclusively, unless these contradict the provisions at hand. Amendments and additions to this contract shall require written form. This shall also apply to ancillary agreements and the wavering of the written form requirement.

7.6. Should one of the provisions of this contract be or become invalid, the validity of the remaining clauses shall remain unaffected thereby. The invalid provision shall be replaced by a valid clause that comes closest to the provision to be replaced in economic and legal terms.
