The set of data you provided to buy and download AUTOVIEW will be stored savely and used exclusively by us to give you a good service. We shall not share this information with third parties. 

License Agreement

This license agreement is intended exclusively for entrepreneurs, commercial users, public authorities and professional users. Consumers within the meaning of the applicable national consumer protection laws are excluded from acquisition and use.

The following agreement is concluded between

AUTOVIEW Crash Analyse e.U., FN 480694d, Reklewskigasse 2-10/9, 1230 Vienna, Austria (“AUTOVIEW”)

and

you (“Customer”)

as follows:

1. Subject Matter of the Agreement

The subject matter of this agreement is an individual drawing or the “AUTOVIEW Vehicle Drawing Database”, a collection of copyrighted drawings including their structure, organization and file system (hereinafter referred to as the “Database”), which is acquired by the Customer for permanent use against a one-time payment and delivered on DVD as data carrier or downloaded by the Customer from www.autoview.at.

The Database consists exclusively of drawings. In order to use the views, the Customer requires one of the application programs listed in the appendix. The purchase, delivery and installation of the respective application program are not part of this agreement. AUTOVIEW is the holder of the exploitation rights.

2. Scope of Use, Granting of Rights

2.1. The Customer acquires the perpetual, non-exclusive and non-transferable right to use the Database exclusively for purposes of accident reconstruction, technical visualization, architecture/building planning and graphic design within the Customer’s company. Use is limited to one company location within the EEA and a maximum of 5 workstations (workstation, notebook, tablet, etc.). In the case of installation within a local area network (LAN), a maximum of 5 persons may access the data simultaneously. Use at multiple company locations, on more than 5 workstations, by more than 5 persons within the network, as an intranet solution or within cloud-based multi-user systems requires a separate written agreement.

The Customer is entitled to reproduce the Database solely to the extent necessary for contractual use, in particular for installation, loading and backup purposes. Any further reproduction is prohibited.

2.2. The Customer is not permitted to rent, lend, transfer, sublicense or otherwise make the Database or individual parts thereof available to third parties.

2.3. Without prior written consent of AUTOVIEW, the Customer is in particular not permitted to:

- independently modify the structure of the Database or the data format,
- implement the drawings or derived data into software, databases or automated systems,
- automatically read out, analyze or extract geometry, measurement, structural or other technical data from the Database or drawings,
- use the Database or drawings for machine learning, AI training or comparable automated systems,
- create or have created 3D models, parametric models, meshes or other digital vehicle models from the drawings or derived data,
- use the Database or drawings for the development, expansion or population of competing databases, model libraries, software products or similar systems,
- apply reverse engineering or comparable methods to the Database or its structure.

2.4. If the Customer has permanently ceased use of the Database, the Customer shall completely and irreversibly delete all copies of the Database in its possession, including backup copies, unless statutory retention obligations apply.

2.5. The Customer is obligated not to remove, alter or manipulate copyright notices, markings or control identifiers of AUTOVIEW on the Database or on copies thereof under any circumstances.

2.6. The Customer acquires the perpetual, non-exclusive right to reproduce and modify individual drawings for purposes of accident reconstruction, technical visualization, architecture/building planning and graphic design to the extent required for such purposes.

The use of modified or unmodified individual drawings within the scope of specific projects, expert reports, proceedings and visualizations of the Customer is permitted.

However, the systematic, regular or extensive publication, provision or commercial exploitation of the drawings or modified versions thereof outside specific projects or proceedings is not permitted, in particular as standalone content within publicly accessible or serially distributed media, systems or data collections.

Furthermore, any use enabling the creation of competing data collections, model libraries or comparable systems is prohibited.

All rights to the original drawings, data structures and data collections remain exclusively with AUTOVIEW. The Customer does not acquire ownership of the underlying data collections or their structure.

3. Duration of Use

3.1. The Customer’s rights to use the Database and/or individual drawings under the provisions of this agreement are granted for an unlimited period of time. The right of use is granted upon full payment of the agreed remuneration.

3.2. In the event of a material breach of the license terms, in particular unauthorized transfer, use for the creation of competing data collections or use contrary to clause 2.3., AUTOVIEW shall be entitled to revoke the rights of use for good cause.

4. Remuneration

The purchase price for the drawings and the granting of licenses amounts to

€ 655    for a full version of the AUTOVIEW Database

€ 510    for the Update2026 for AUTOVIEW2024 and older full versions

€ 250    for the Update2026 for a full version AUTOVIEW2025

€ 9.5    for an individual drawing (one view, one file format)

plus statutory value added tax. The total purchase price (including VAT) becomes due upon complete download of the Database from the website www.autoview.at and shall be transferred electronically.

5. Set-Off

The right of set-off is excluded.

6. Warranty and Liability

6.1. The Customer is obligated to inspect the Database for functionality immediately after delivery/download within 5 working days. If the Customer discovers defects during this inspection, the Customer is obligated to immediately submit a written notice of defects to AUTOVIEW specifying the detected defects in detail; otherwise, claims for warranty, damages due to the defect itself and claims based on error regarding the defect-free condition of the product shall be excluded.

6.2. The warranty period shall expire, irrespective of the obligation to inspect, 12 months after the date of delivery/download.

6.3. If the Customer independently modifies the data inventory and/or the data format, all warranty claims shall be forfeited.

6.4. AUTOVIEW warrants that the Database and the original individual drawings are free from third-party intellectual property rights that restrict or exclude contractual use. However, the parties shall immediately inform each other if claims due to infringement of intellectual property rights are asserted against them.

6.5. AUTOVIEW shall only be liable within the mandatory statutory scope, namely for intent and gross negligence. Liability is limited in amount to the respective contractual remuneration. Certain characteristics of the drawings cannot be guaranteed.

7. General Provisions

7.1. Austrian law shall apply exclusively. The application of the UN Convention on Contracts for the International Sale of Goods and other conflict-of-law rules is expressly excluded.

7.2. Place of performance is the registered office of AUTOVIEW.

7.3. Place of jurisdiction is the competent court in Vienna, Austria.

7.4. Appendix 1 forms an integral part of this agreement.

7.5. Any oral or written agreements made prior to conclusion of the contract shall lose their validity upon signing insofar as they concern the subject matter of the contract; exclusively the terms and conditions of AUTOVIEW shall apply insofar as they do not contradict the present provisions. Amendments and supplements to this agreement must be made in writing; this also applies to ancillary agreements and any waiver of the written form requirement.

7.6. Should any provision of this agreement be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest economically and legally to the provision to be replaced.
